The following terms and conditions apply:
Agreement to Terms: Purchase of a ticket constitutes full agreement by the purchaser to all terms and conditions set forth herein.
Eligibility: Participants must be U.S. residents and age 18 or older to purchase a ticket and to win any prize. Employees of Donate Life Kentucky Trust are not eligible to participate. Void where prohibited by law. Net proceeds support the charitable mission of Donate Life Kentucky Trust.
Ticket Purchase and Validity: A ticket represents a chance to win the opportunity to accept an offer of the stated prize under these terms and conditions and any additional terms set forth in the Winner Agreement. The IRS has determined that raffle ticket purchases are not tax-deductible as charitable contributions. All raffle ticket sales are final; no refunds will be issued. Tickets, receipts, and winners’ rights are non-transferable.
Multiple-Party Entries: If more than one name is listed on a ticket, the prize will be awarded to the first person listed who is age 18 or older and a U.S. resident. It is the sole responsibility of the winner in a multiple-party entry to allocate the prize among the participants on that entry. If the prize is to be shared among individuals, the winner must complete IRS Form 5754 to allocate tax liability. When purchasing tickets online or in person, the name entered first on the transaction form will be recorded as the official ticket holder. If multiple tickets are purchased in a single transaction, they will all be associated with that name unless otherwise specified at the time of purchase.
Prize Details: Grand Prize: A Utility Terrain Vehicle (UTV). The UTV awarded may differ in appearance or features from promotional images. Donate Life Kentucky Trust makes no warranties or representations regarding the prize and disclaims any such warranties. Prize winners may rely only on the manufacturer’s warranties, if any. The prize may not be substituted or exchanged by the winner. Donate Life Kentucky Trust reserves the right to substitute a prize of equal or greater value if the UTV is unavailable.
Drawing and Winner Selection: The prize drawing will be held on August 20, 2025 at 2 p.m. EST, at Donate Life Kentucky Trust, 10301 Linn Station Road, Louisville, KY 40223. Donate Life Kentucky Trust reserves the right to postpone the drawing if necessary. Winning tickets will be selected by random drawing; all participants have an equal chance to win. Winners need not be present to win. Donate Life Kentucky Trust will make reasonable attempts to contact the winner on the day of the drawing and weekly or more for 30 days after winning if winner does not respond.
Winner Notification and Acceptance: The winner will be notified in writing with a Winner Notification Form, which will include tax forms required by IRS. The winner must claim the prize within 30 days of receiving notice. If the winner chooses not to accept the prize and instead wishes to donate it back to Donate Life Kentucky Trust, a written statement must be provided within the 30-day period. Failure to claim the prize within 30 days will result in forfeiture, and a new winner will be drawn in accordance with the Kentucky Charitable Gaming regulations. The winner has no rights to the prize until it is fully accepted by returning the Winner Agreement and completing any legal requirements. The prize remains the sole property of Donate Life Kentucky Trust until unconditionally accepted by the winner.
Prize Delivery and Winner Responsibilities: The winner is responsible for all costs associated with applicable taxes, registration, licensing, insurance, transportation, and delivery of the UTV, as well as any upgrades or accessories requested.
Taxes and Legal Requirements: Winner is solely responsible for all federal, state, and local income taxes and any other applicable taxes, fees, or charges due as a result of accepting the prize. The IRS requires that taxes on prizes valued greater than $5,000 must be paid. Winners are encouraged to consult a tax professional.
Publicity Release: Acceptance of the prize constitutes permission for Donate Life Kentucky Trust to use the winner’s name, photograph, video image, and relevant quotes for promotional purposes.
Disqualification Clause: Donate Life Kentucky Trust reserves the right to disqualify any entrant found to be tampering with the entry process or violating these official rules in any way.
Force Majeure / Event Cancellation: In the event that the raffle drawing cannot be conducted due to circumstances beyond the control of Donate Life Kentucky Trust, including but not limited to natural disaster, pandemic, act of God, terrorism, government regulation, or other force majeure, Donate Life Kentucky Trust reserves the right to cancel, terminate, modify, or suspend the raffle and refund ticket purchases at its sole discretion.
